Busy Fall schedule. With back-to-back trials throughout the last few months, several clients extremely pleased to finally get their day in Court!

So, the House of Representives is voting on a replacement for the Affordable Care Act.

This Act has been essential to many of my clients who, due to various circumstances, could not get health insurance coverage without it. Now, Congress is seeking to undo the progress we've made, render millions uninsured and make health insurance incaccessable to many.

The new proposal is supposedly to keep coverage for pre-existing conditions by paying the insurance industry a whopping $8,000,000,000. In the past, such subsidies have not worked to the advantage of citizens. What I predict is that the insurance companies will accept the hand-out, continue to raise premiums, and then declare the system a failure when the poor opt out. I see this as nothing more than a money-grab by the insurance companies, who continue to buy our Congressmen.

Britax recalls more than 700,000 mounting components.

Twenty-six reports of injury before the company did anything. Unfortunately, in this day and age, it takes litigation and the threat of paying out millions in damages to make a manufacturer take notice that its products are causing injury. Although the media cringes at large verdicts, the truth of the matter is that these lawuits ultimately save lives (and limbs).

If you have been injured by a product, don't assume that it's your fault! Give The Law Office of Matthew J. Broder a call!

With the holiday season upon us, if you are in the middle of a divorce, it is important to remember:

1. Your kids are not the cause of your divorrce, so don't make them pay for it.

2. You CAN keep it together during the holidays despite your impending separation/divorce.

3. If you and your soon-to-be ex are not getting along, that is why you're getting a divorce.

4. Every issue is not a cause to do battle.

5. Keep your sense of humor, and enjoy the holidays.

6. This, too, shall pass. Next year will be a new beginning.

This is a good read regarding the current Supreme Court appointment (or lack thereof) issue:

https://www.minnpost.com/eric-black-ink/2016/02/what-does-constitution-say-about-picking-supreme-court-justices-not-much

Is the failure of Congress to hold a hearing a Constitutional Violation? The Constitution specifically says t “[The President] shall nominate, and by and with the Advice and Consent of the Senate, shall appoint…Judges of the Supreme Court.”

In my view, the Senate's refusal to hold a hearing to even discuss the President's nomination is a failure to "advise" and "consent", and thus, it does constitute an unconstitutional failure to act.
